The terms "we", "us", and "our" refer to Vantage Labs, LLC, Vantage Learning (USA), LLC, McCann Associates Holdings, LLC and/or VantageOnLineStore.com, LLC, the international distributor for McCann and Vantage or any of their affiliated companies (collectively "Vantage"). "You", "your", "grantee", "subscriber" or "end-user" refer to the individual and/or entity that has procured and/or who (which) accesses or uses Services. "Subscription Services" or "services" refer to software service application accessed by you via the internet. "Technical services" refer to support, consulting, or other services including customizations you have ordered (if any apply). The terms 'Subscription Services' or 'service(s)' may be used interchangeably within this document. Our Commitment:Vantage strongly values your privacy. This privacy policy describes what information we collect, how it is processed, stored and used. MY Access! (www.myaccess.com) is an award-winning, online writing instruction and assessment program, and teaching tool that improves student writing proficiency and motivates students to write more frequently by providing immediate scores and continual, adaptive, prescriptive feedback and edit suggestions. As a result, MY Access! rapidly improves student writing proficiency, which helps schools achieve state literacy standards, reduces workload for teachers, and empowers teachers to spend more time on differentiated instruction and intervention. Students in grades 3rd through 12th grade compose essays to writing prompts assigned by the child’s teacher or school/district administration and submit for score and instructional feedback. As set forth in this section, we comply with the following laws concerning the protection of student personally identifiable information, including educational records: the Family Educational Rights and Privacy Act (“FERPA”) at 20 U.S.C. 1232g (34 CFR Part 99), Children’s Online Privacy Protection Act (“COPPA”), 15 U.S.C. 6501-6506; Protection of Pupil Rights Amendment (“PPRA”) 20 U.S.C. 1232h, AB 1584 (codified at California Education Code § 49073.1), and the Student Online Personal Information Protection Act (codified at California Business and Professions Code § 22584 et seq.), and any specific state laws (as applicable to us) protecting student personally identifiable information which are listed in the table at the end of this Privacy Policy as of the date set forth in such table. As to COPPA or any state law which requires consent or authorization from a parent or guardian for the collection or use of information concerning a student, the school or school district, is responsible and liable for fulfilling any applicable consent requirement. Vantage neither owns nor ultimately exercises direct control over any student information provided by a school. The information provided is used simply and exclusively to ensure that your child gains access to and can use MY Access! program. All student information provided to Vantage always remains confidential. Vantage does not use, transmit or disseminate any student information for any other purpose than to effectuate and fulfill its responsibilities and obligations to your child's school, school district or other educational institution or program ("school"). Vantage neither requests, culls or collects any additional information about any student that is not directly provided by a child's school or included within a school's request of Vantage (as part of a program). At times, Vantage uses or compiles raw non-specific student data only for research studies and quality control purposes. If information is compiled or collected for such purposes, students are not personally identifiable(“Non-Identifying Information”) - their identities are completely anonymous and never subject to release or publication. Your child's school bears exclusive responsibility for and is deemed to exercise ultimate policy and decision-making authority over any and all aspects or associated undertakings of its use and application of the MY Access! program. Reviewing, Changing, or Deleting InformationMY Access! is accessible to students under the age of 18 only when such students are designated and provided by the school or district. If you are a parent or guardian and have questions about your child’s use of MY Access! and any personal information collected, please direct these questions to your child’s school. As a parent, you may request that your child's account be deleted from our database by writing to your school administrators. Your child’s school will contact us to communicate the request and coordinate the deactivation and deletion of student data. We will retain Student information for as long as the school or district subscription is active or as needed to provide the service. Generally, unless a legal request has been made for a user’s personally identifiable information, we do not retain and will delete or anonymize personally identifiable information within a reasonable period after we are informed the Account will no longer be used, or if an Account becomes inactive and we are unable to contact the relevant school or school district. We may use aggregated and anonymized information derived from your personally identifiable information after you update or delete it, but not in a manner that would identify you personally. CookiesA cookie is a small file containing a string of characters that is sent to your computer when you visit a website. Usage of a cookie is in no way linked to any personally identifiable information while using MY Access! MY Access! uses session ID cookies to speed and enhance a student's navigation within MY Access! Once a user closes the browser, the cookie automatically terminates. Log FilesLike most standard Internet website servers, Vantage uses log files that identify a user's Internet protocol (“IP”) address, browser type, Internet service provider (ISP), referring/exit pages, platform type, date/time stamp, and number of clicks to analyze trends, administer the site, track time spend on pages within the site (“Site Usage Data”). None of this information is ever linked to personally identifiable student information. SharingVantage never sells, shares, rents or distributes information provided by schools to anyone other than a designated or authorized school official, administrator or authority legally entitled to review such information. Under certain circumstances, Vantage may be directed to disclose personally identifiable information when required by law based upon a good-faith belief that such action is necessary to comply with an appropriate law enforcement investigation, current judicial proceeding, court order or legal process served on the MY Access! website. LinksOur Site may include links to other websites (“Third Party Services”). We do not exercise control over Third Party Services. If you submit personal information to any of those sites, your information is governed by their privacy policies. We encourage you to carefully read the privacy policy of any website you visit. Vantage never links its MY Access! website to any other site not preauthorized and determined to be beneficial for student development by a student's school. SecurityMY Access! takes every precaution to protect user information. Our security policy and procedures are in place to protect the security, privacy, confidentiality, and integrity of personal information and proactively mitigate risks through the use of administrative, technological, and physical safeguards, including encryption. Any information provided to Vantage is restricted to Vantage's offices and employees. Furthermore, all employees are trained on insecurity and privacy practices. From time to time, as new policies are added or existing policies are modified, employees will be notified and/or trained about the importance Vantage places on privacy and how they can ensure that information is protected. Site and Service UpdatesSite and service announcement updates are provided on the MY Access! website and are also communicated to district and school administration users by e-mail. However, these communications are not promotional in nature. If you do not wish to receive these updates, you may click on the unsubscribe link located on the bottom of the e-mail.
